Terms and Conditions

The following terms and conditions will apply to all bookings and will form the basis of your contract with the company ANANDA HOLIDAYS S.L.

1. ENROLMENT

All arrangements are made subject to the following terms and conditions. When you make a booking with ‘ANANDA HOLIDAYS’ you undertake that you have the authority to accept and do accept these booking conditions on behalf of yourself and your party. A contract will exist upon our accepting any monies from you towards the booking, or upon the issue of our Confirmation/Invoice, whichever is the earlier.

By making a reservation or booking with a school or supplier for a stay, you accept and agree to the relevant cancellation and no-show conditions of the activity, trip, accommodation, experience or course, and to any additional terms and conditions of the school/hotel that may apply to your reservation, booking or during your stay, including for services rendered and/or products offered by the supplier of services (the terms and conditions of any supplier can be obtained with the relevant supplier).

Sometimes our suppliers have different specific conditions for booking, cancellations or no-show. The specific booking, cancellation and no-show policy of each supplier for training, course or hotel is made available on our website at the training or course information pages, during the booking procedure and in the confirmation email.

Prices and payment

1. Your use of the Platform is free of charge. The payments will be always made  in Euros (€).

2. Please be aware that specific payment terms of the organizers apply to payment of the trips.”

3. When using the Platform, you will be able to convert the prices of Experience Offers to the available currencies. Such converted prices are only indicative. At the moment of payment, the price of the Experience offered will be converted in real-time to the currency as specified by the Organizer. This amount may differ from the amount displayed at an earlier moment. The price displayed after such real-time conversion will be the amount you are due for the relevant Reservation.

For instance, an organizer offering services in Spain will charge you In EUR since it is the local coin of the organizer where the service is provided, so you can convert the price in other currencies just for your information, but at the moments of paying the deposit and the moment of paying the balance you will have to pay the amount showed in EUR, no matter the fluctuations other coins may suffer between the payment of the deposit and the payment of the balance.

4. Since the Organizers are responsible for the payments terms, you cannot derive any rights from the currencies or payment methods available at a certain moment. Furthermore, ANANDA HOLIDAYS is not responsible for and has no influence on the applicable payment terms.

2. DEPOSIT

Once we receive confirmation of availability from the supplier, we will send you the right instructions to complete the booking.

You need to pay the deposit in order we can secure your place in the trip, activity, event or course for you.

Unless other specific conditions of the organizer is stated, a deposit of 30% from the total amount  (bank transfer costs paid by the customer, or Paypal 3% surcharge ) per person will be paid to ANANDA HOLIDAYS as a deposit.

As soon as we receive it, we will procceed with the booking of your chosen holiday.

The deposit paid at the time of booking will be non-refundable, except in the event of the booking not being accepted by us for any reason, or if due to unforeseen circumstances we are unable to provide the course for which you have booked.

3. BALANCE

Unless other specific conditions of the organizer apply and are detailed in the description of the trip, the rest of the full fee must be paid in full at least 31 DAYS  BEFORE THE ARRIVAL DATE. If the balance remains unpaid more time than 31 DAYS prior to departure date, we reserve the right to cancel the booking and retain the deposit.

In some cases, some suppliers may allow to pay the rest of the full amount even upon arrival. Please check carefully the specific conditions that may apply.

Under no circumstances No compensation, fee reductions, refunds, credit, additional lessons or extension of the course can be given for:

  1. -services or facilities included in the fees and not used
  2. -late entry to or absence or early departure from a course, event, activity or accommodation.
  3. -lessons replaced by testing and class allocation procedures on course entry dates
  4. -days when schools are closed because of official holidays.

Any refunds of the balance must be approved by the supplier.

ANANDA HOLIDAYS reserves the right to make fee adjustments as a result of changes in the exchange rates or statutory taxes.

4. CANCELLATIONS AND NO SHOW

Cancellations must be made in writing to us by the person who made the booking. Please take into account that the deposit is non refundable in any case.

We know that sometimes things comes up, and unexpected events happen that make you impossible from going on a holiday you’e planned.

If you’re totally sure you wont be able to do the trip, the best thing you can do is cancel.

Then, we can try to ask the supplier to be more flexible, but we can not guarantee their answer.

The GENERAL CONDITIONS of ANANDA HOLIDAYS are working with (unless others are specified by the suppliers in the description of the trip) are the following:

A. 31 DAYS OR MORE BEFORE THE DEPARTURE DATE:

No cancellation costs. Only the deposit wont be refundable.

B. BETWEEN 23 DAYS AND 31 DAYS BEFORE THE DEPARTURE DATE:

You will be refunded the 50% of the total price of the booking.

C. BETWEEN 15 DAYS AND 22 DAYS BEFORE THE DEPARTURE DATE:

You will be refunded the 25% of the total price of the booking.

D. 14 DAYS OR LESS BEFORE THE DEPARTURE DATE, OR IN CASE NO SHOW:

0% refund of the total price of the booking.

We encourage you to take an insurance that may cover you in certain situations, so in case you can not go finally to the trip, you could be covered. And if you can, you are covered once in the destination.

Sometimes the supplier specifies other conditions:by making a reservation or booking with a specific supplier, you accept and agree to the relevant cancellation and no-show conditions of the training or course, and to any additional terms and conditions of the school that may apply to your reservation, booking or during your stay, including for services rendered and/or products offered by the school (the terms and conditions of a school can be obtained with the relevant school). The general cancellation and no-show policy of each training or course is made available on our website at the activity or course information pages, during the booking procedure and in the confirmation email. Please check the booking conditions thoroughly for any such conditions prior to making your booking.

Cancellation is free only if done before the cancellation date mentioned in the confirmation email. Cancellation periods vary by booking. When cancelled before the cancellation date mentioned in the confirmation email we will try to refund the money to the payment method you have paid with. If not possible or when we prefer we will transfer the money to your PayPal account or by Western Union. The possible bank charges will be for the customer when refunding.

Money transfer / transaction fees are for your charge.

We shall not accept responsibility for any cancellations or effect on your holiday due to war, threat of war, civil strife, industrial dispute, terrorist action, natural or nuclear disaster, fire or adverse weather conditions.

Cancellation by ANANDA HOLIDAYS

 

  1. If a customer or group does not comply with the terms and conditions at our school or hotel, ANANDA HOLIDAYS reserves the right to cancel the contract with immediate effect.

The course fees will not be reimbursed. Possible surcharges, e.g. additional airport transfer charges, will be invoiced to the customer.

Should you decide not to utilize services booked with ANANDA HOLIDAYS after the commencement of your course there will be no reimbursement of fees.

5. Person in your place by changing the name.

Up until the course or activity  commencement SOME SUPPLIERS give the possibility for somebody else to take the course instead of yourself. ANANDA HOLIDAYS and the SUPPLIERS reserves the right to reject this person if he / she does not meet the course or any legal requirements. The handling charge for this change of names is 25 euros. This price doesn not apply to change the name in the case of flights, just accommodation and courses, when possible.Should there be any other costs, e.g. airport pickup for courses which do not include this service, a separate charge will be made.

6. Credit card AND DEBIT CARDS

Hotels and some suppliers require credit card details in order to guarantee your reservation. As such, we will send your credit card information directly to the hotel at which your booking is made and we or them may verify (i.e. pre-authorise) your credit card as well.

In order to safeguard and encrypt your credit card information when in transit to us, we use secure technology for our services.

For certain rates or special offers, please note that your credit card may be pre-authorised or charged (sometimes without any option for refund) upon reservation and confirmation of the booking. Please check the room details thoroughly for any such conditions prior to making your reservation.

7. ADVERTISEMENTS

We reserve the right to withdraw or modify at any time the arrangements advertised where necessary to do so.

All reasonable and proper steps have been taken to ensure that the accommodation and services are as advertised. We will be responsible for any acts or omissions of our own employees and agents whilst acting within the scope of their employment but cannot be responsible for the acts or omissions of those providing services over which we have no direct control.

8. PASSPORT, VISA, CUSTOMS RESTRICTIONS

It is a requirement of the booking that you must arrange adequate holiday insurance. Such insurance should cover full medical expenses, personal baggage, personal accident, accident, loss or damage to property, cancellation or curtailment, personal liability, legal expenses and emergency.

All travellers need valid Passports and in case they need a VISA they have to organize in time before the departure. It is each customer’s responsibility to keep to these restrictions.

Non-compliance with these regulations and any costs that might be incurred due to this are the customer’s responsibility.

9. OUR ROLE

ANANDA HOLIDAYS is a travel agency registered in Spain with the licence XG-659 and can not only sells trips all around the worls, but also act as an intermediary between schools,  accommodation providers, and tour-operators. We are not responsable for changes, losses and cancellations produced by any of them.

Through the website ANANDA HOLIDAYS provide an online platform through which suppliers of services can advertise their services, and through which visitors to the website can make such reservations through us.  Also through the website we can offer any kind of touristic experience and trips.

By making a reservation through ANANDA HOLIDAYS, you enter into a direct (legally binding) contractual relationship with the providers at which you book, and with Ananda Holidays-

When rendering our services, the information that we disclose is based on the information provided to us by the suppliers. As such, the suppliers are fully responsible for updating all rates, availability and other information given which is displayed on our website. Although we will use reasonable skill and care in performing our services we cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information.

Each supplier remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of (the quality, service level or rating of) any hotel made available.

Our services are made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, blog, videos, products or services available on our website for any commercial or competitive activity or purpose.

10. GUEST REVIEWS

The completed guest review has the sole purpose of informing future customers of your opinion of the service and can be used and placed by ANANDA HOLIDAYS at its sole discretion (e.g. for marketing, promotion or improvement of our service) on our website or such social media platforms, newsletters, special promotions, apps or other channels owned, hosted, used or controlled by ANANDA HOLIDAYS. We reserve the right to adjust, refuse or remove reviews at our sole discretion.

The guest review should be regarded as a survey and does not include any (further commercial) offers, invitations or incentives whatsoever.

11. MISCELLANEOUS

Any general health, passport, visainsurance,  or other travel advice is not intended to be, nor is it to be treated as a substitute for, professional medical advice relative to a specific medical question or condition, or for checking the relevant passport, visa or other travel requirements applicable to the destination that you are intending visiting. ALWAYS seek the advice of your doctor for any questions you may have regarding a medical condition or requirements before considering a holiday or before travelling, together with the relevant passport, visa and travel requirements for the specific destination you intend travelling to, within good time before you travel.

We shall not be responsible for luggage lost in transit while the responsibility of an airline. Where possible we will provide advice and assistance in seeking to retrieve any luggage so lost.

We will not be responsible if you suffer illness, personal injury or death as a result of misadventure during the period of your overseas trip arising out of an activity that does not form part of the course provided by us.

To the extent permitted by law, neither we ANANDA HOLIDAYS, nor our partners, licensees, agents or others involved in creating, sponsoring, promoting, or otherwise making available the site and its contents shall be liable for

  1. any punitive, special, indirect or consequential loss or damages, any loss of production, loss of profit, loss of revenue, loss of contract, loss of or damage to goodwill or reputation, loss of claim,
  2. any inaccuracy relating to the (descriptive) information (including rates, availability and ratings) of the hotel as made available on our website
  3. the services rendered or the products offered by the hotel
  4. any (direct, indirect, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, pursuant to, arising out of or in connection with the use, inability to use or delay of our website, or
  5. for any (personal) injury, death, property damage, or other (direct, indirect, special, consequential or punitive) damages, losses or costs suffered, incurred or paid by you, whether due to (legal) acts, errors, breaches, (gross) negligence, willful misconduct, omissions, non-performance, misrepresentations, tort or strict liability by or (wholly or partly) attributable to the hotel (its employees, directors, officers, agents, representatives or affiliated companies), including any (partial) cancellation, overbooking, strike, force majeure or any other event beyond our control.
12. CONTRACT AND ACCEPTANCE OF THE CONDITIONS

The contract, of which this forms part, shall be governed BY THE LAW OF the city of Vigo, in  SPAIN, and any legal problem must be solved in this country.

By enrolling any of our courses or stays, customers accept these conditions.
